Returns & Refunds policy
You are entitled to cancel your order within 30 days without giving any reason for doing so.
The deadline for canceling an order is 30 days from the date you received the goods or on which a third party you have appointed, who is not the carrier, takes possession of the product delivered.
In order to exercise your right of cancellation, you must inform us of your decision by means of a clear statement.

We will reimburse you no later than 30 days from the day on which we receive the returned goods. We will use the same means of payment as you used for the order, and you will not incur any fees for such reimbursement.

The following goods cannot be returned:
The supply of goods made to your specifications or clearly personalized.
The supply of goods which according to their nature are not suitable to be returned, for example goods which deteriorate rapidly or where the date of expiry is over.
The supply of goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
The supply of goods which are, after delivery, according to their nature, inseparably mixed with other items.
We reserve the right to refuse returns of any merchandise that does not meet the above return conditions at our sole discretion.
Returning Goods

We cannot be held responsible for goods damaged or lost in return shipment. Therefore, we recommend an insured and trackable mail service. We are unable to issue a refund without actual receipt of the goods or proof of received return delivery.
Gifts:
If the goods were marked as a gift when purchased and then shipped directly to you, you'll receive a gift credit for the value of your return. Once the returned product is received, a gift certificate will be mailed to you.
If the goods weren't marked as a gift when purchased, or the gift giver had the order shipped to themselves to give it to you later, We will send the refund to the gift giver.

Kairosgraph - Terms and Conditions

These Terms and Conditions (“Terms”) constitute a binding agreement between Kairosgraph (“Kairosgraph,” “we,” “our,” or “us”) and you, the Client (“Client” or “you”). By engaging Kairosgraph for photography and/or cinematography services, you agree to these Terms. Please read them carefully and consult a legal advisor if necessary.
1. Definitions
“Services”: Refers to all photography, cinematography, editing, and post-production services provided by Kairosgraph, including but not limited to private events (e.g., weddings, birthdays) and commercial photography (e.g., product, real estate).
“Deliverables”: Refers to the final photos, videos, and other media provided to the Client following completion of the Services.
“Agreement”: Refers to this Terms and Conditions document, any signed contracts, and other agreements related to the services provided by Kairosgraph.
2. Scope of Services
The Services provided by Kairosgraph are outlined in a separate service contract specific to the Client’s project.
Kairosgraph reserves the right to refuse any service or modify any service offering at its sole discretion.
3. Booking and Payments
Deposit: A non-refundable deposit is required to secure the booking date. Bookings are confirmed only upon receipt of this deposit.
Payment Schedule: Full payment must be completed by the date specified in the contract, typically [7–30] days before the event date.
Additional Fees: Any additional services or hours requested by the Client will incur additional charges, payable on or before the final deliverables are provided.
Late Payments: If payments are not made according to the agreed schedule, Kairosgraph reserves the right to withhold Services and/or Deliverables until full payment is received. A late fee may be charged on overdue payments.
4. Cancellations and Refunds
Client Cancellation: If the Client cancels the service, the deposit is non-refundable. For cancellations within [30/60] days of the event date, the Client may be responsible for a percentage or full payment of the remaining balance.
Force Majeure: Kairosgraph is not liable for non-performance due to unforeseen events beyond its control, including but not limited to natural disasters, illness, or governmental restrictions. In such cases, a reschedule or partial refund may be negotiated.
Photographer Replacement: In the unlikely event that Kairosgraph is unable to attend due to illness or emergency, we reserve the right to substitute with a qualified photographer or provide a full refund.
5. Intellectual Property and Usage Rights
Copyright: All images, videos, and Deliverables created by Kairosgraph are protected by copyright and are the exclusive property of Kairosgraph.
Client Usage: The Client is granted a non-exclusive, non-transferable license to use the Deliverables for personal, non-commercial use, unless otherwise agreed upon in writing.
Commercial Use: For commercial photography projects, the Client’s usage rights will be specified in the contract. Any further commercial use of images requires additional fees or written permission from Kairosgraph.
Portfolio and Marketing Rights: Kairosgraph reserves the right to use any images or videos from the Client’s event or project for portfolio, promotional, marketing, and social media purposes, unless the Client submits a written request to restrict usage.
6. Event and Environmental Limitations
Cooperation: The Client agrees to cooperate fully with Kairosgraph and follow any directions to ensure the successful outcome of the Services. Kairosgraph is not responsible for missed shots or reduced quality due to non-cooperation.
Venue Restrictions: Kairosgraph will abide by any venue restrictions or policies regarding photography. However, Kairosgraph is not responsible for restrictions that limit the quality or quantity of photographs.
Environmental Conditions: Kairosgraph is not liable for compromised image quality or delays caused by environmental factors, including but not limited to lighting, weather, or other external factors.
7. Deliverables and Timeline
Delivery Timeline: Kairosgraph will make every effort to deliver the final edited Deliverables within [4–6 weeks] post-event. The timeline for commercial projects will vary based on the agreed-upon terms in the contract.
Digital Storage and Access: Kairosgraph offers complimentary digital storage of Client Deliverables for up to six months following the event date. After this period, digital files may be deleted, unless a storage extension is purchased.
Photo and Flex Prints: On-demand photo and flex prints are available for an additional cost, as specified in the contract.
8. Liability and Indemnity
Limitation of Liability: Kairosgraph will take every precaution to capture high-quality images; however, we are not liable for circumstances beyond our control. In the unlikely event of lost or damaged files, liability will be limited to a refund or partial refund of the total payment received.
Indemnity: The Client agrees to indemnify and hold harmless Kairosgraph and its employees from any claims, damages, or expenses arising out of the Client’s actions or the actions of others at the event or location.
9. Data Protection and Privacy
Personal Information: Kairosgraph collects personal information necessary to fulfill its contractual obligations. All personal data is processed and stored securely.
Data Retention: Personal information is retained only for as long as needed to fulfill the purposes for which it was collected or as required by law.
Client Access: Clients may request access to their personal information and ask for corrections if necessary. Please refer to our Privacy Policy for detailed information.
10. Confidentiality
Kairosgraph respects the confidentiality of our Clients. Any information shared by the Client, including photos, videos, or event details, will remain confidential unless written consent for disclosure is provided.
11. Amendments to Terms and Conditions
Kairosgraph reserves the right to update or amend these Terms and Conditions at any time. Changes will be effective immediately upon posting, and the Client will be notified of any material changes. Continued use of Services constitutes acceptance of the modified terms.
12. Dispute Resolution and Governing Law
Governing Law: These Terms and Conditions are governed by and construed in accordance with the laws of West Bengal, without regard to conflict of law principles.
Dispute Resolution: Any disputes arising from these Terms or the Services will be resolved through [binding arbitration/mediation] in [Location], unless otherwise specified in the service contract.
Jurisdiction: In the event of legal proceedings, the Client agrees to submit to the exclusive jurisdiction of the courts located in Serampore.
